By using Highland Fine Cheeses Ltd website, you agree to be bound by the terms and conditions set out within it. Nothing in these terms and conditions affects your statutory rights as a consumer, or otherwise.
You may access and use the Highland Fine Cheeses Ltd website for your personal, non-commercial use. You may not use the Highland Fine Cheeses Ltd website or its contents for any commercial purposes without prior consent from one of the Directors of Highland Fine Cheeses Ltd.
The Highland Fine Cheeses Ltd website and its content including all text, graphics, logos, button icons, images, data compilations and software used in connection with the Highland Fine Cheeses Ltd website, is our property or that of our suppliers and is protected by copyright, trade marks, database rights and other intellectual property rights.
We do not represent or warrant that the material contained in the Highland Fine Cheeses Ltd website, any of the functions of the Highland Fine Cheeses Ltd website and the server will operate without interruption or delay or will be error-free, free from defects, viruses or bugs or compatible with any other software or material. We will not be responsible to you or any third party for any business loss (including loss of revenue, profits, contracts, anticipated savings, wasted expenditure, data or goodwill) or any other loss or damage which does not result directly from our actions or the actions of our sub-contractors or suppliers, is consequential or was not reasonably foreseeable to both you and us when the contract between us was formed.
Our liability to you under these terms and conditions will not exceed the total price charged for the items purchased. Nothing in these terms and conditions excludes our liability to you for personal injury or death caused by our negligence.
We reserve the right at any time to make changes to this website, these terms and conditions, our Privacy Policy and such other policies as we may notify you of.
You will be subject to the policies and terms and conditions in force at the time you use the Highland Fine Cheeses Ltd website or order items from the Highland Fine Cheeses Ltd website. Changes which we are required to make by law could apply to orders which you have already made.
You agree fully to indemnify, defend and hold us, and our officers, directors, employees, agents and suppliers, harmless immediately on demand, from and against all claims, liability, damages, losses, costs and expenses, including reasonable legal fees, arising out of any breach of these terms and conditions by you or any other liabilities arising out of your use of the Highland Fine Cheeses Ltd website, or the use by any other person accessing the Highland Fine Cheeses Ltd website using your shopping account and/or your personal information.
Seller and Customer:
The Seller is Highland Fine Cheeses Limited, registered in Scotland No. SC044504. VAT registration number GB 26 703 6946 (“Highland Fine Cheeses”, “we” or “us”). These terms and conditions (of which the Privacy Policy form a part) apply to all orders which you, the customer (“you” or “your”) place using this website, www.hf-cheeses.com for items ordered by Internet.
Placing an order
By completing the checkout process on www.hf-cheeses.com, you are also agreeing to all of our Terms and Conditions as presented on the website.
Goods are subject to availability. If we are unable to supply the goods, we will inform you of this as soon as possible and offer an alternative. If the alternative is not suitable then a full refund will be given if you have already paid for the goods.
We highly recommend you provide us with a correct e-mail address. In this case we will send you an order acknowledgement e-mail. Unless we have notified you that we do not accept your order we will then have entered into a contract. If, in the unlikely event, your order is not accepted, we will notify you via email of why this is the case, and no payment will be taken.
The contract will be formed at the place of dispatch of the goods, namely Scotland.
It is your responsibility to check all the information in the confirmation email is correct, and notify us immediately via email should there be any inaccuracies. We will not be liable for reimbursing you for the value of any goods which have perished or been damaged as a result of your failure to inform us of accurate information being listed on the confirmation email.
Pricing:
Products are invoiced in GBP at the price prevailing at the time you place your order and are not inclusive of delivery fees.
All prices displayed on the Highland Fine Cheeses Ltd Website include Value Added Tax (VAT) which will be charged at the current rate when applicable.
Although we try to ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of items you have ordered, we will contact you as soon as possible. You will have the option of either reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat your order in respect of the incorrectly priced item as cancelled.
We reserve the right to update prices displayed on our website from time to time.
Payment
You may pay for the items which you order online with most major credit cards and debit cards using our secure online checkout. We regret that we cannot accept cheques or cash as payment online.
We can also now accept payments by PayPal. Simply select the PayPal logo in the Checkout and follow the on-screen instructions.
When you place your order, our secure-payment gateway partner Stripe will automatically ask your card issuer for authorisation for this payment.
Please note that we cannot guarantee the security of any data sent by email. Accordingly, please do not send us payment information via email. For details of the security measures we employ, please read our Privacy Policy.
About Stripe:
The Stripe Checkout service (“Stripe Checkout”) is technology that makes it easier for merchants on the Internet (“Merchants”) to collect payment from individuals like you. Stripe Checkout also makes it easy for you to store a credit card or debit card (“Payment Credentials”) with Stripe for use across the websites of Merchants who’ve chosen to enable it.
When you check out on the website of a Merchant that has Stripe Checkout enabled, we will ask you if you’d like us to remember you. When you allow us to remember you, Stripe will store certain identifying information, such as a password, your email address, or your mobile phone number (“Stripe Credentials”), and your Payment Credentials. The advantage of remembering you is that it will make your checkout quicker and easier if you come back to the same website, or to any of the other websites that use Stripe (a “Checkout Enabled Site”)–this can be especially handy when you’re on a mobile device or don’t have your credit card in front of you.

If you want to delete your Payment Credentials, stop storing information using Stripe Checkout, or change your settings, you can send an email to support@stripe.com.
By using Stripe Checkout you represent and warrant that you are at least 18 years of age and that you will not use Stripe Checkout for any fraudulent, unlawful or abusive purpose.
Cancelling an order
Should you wish to cancel an order that has been accepted by us, and a confirmation email has already been sent out to you, we are unable to guarantee that we can cancel the order, and provide a full refund. However, if you email us as soon as possible, and your items have not yet been dispatched, we will endeavour to cancel your order and refund you in full without charge. In cases where your cheese has already been packaged though, this will not be possible.
If you wish to cancel your order, please contact our customer care team at office@hf-cheeses.com or by telephone on 07770 228660 between 09:00 and 17:00, Monday to Friday. Please note our despatch days are Tuesday and Wednesday, it may not always be possible to prevent an order from being dispatched.
If we receive notice of your cancellation in time we will cancel the order and we will not debit your card. If your card as already been debited we will issue a refund.
Cheese description
Our cheeses are produced using artisan methods and therefore subject to seasonal availability and changes in shape/ size etc. All measurements and weights are approximate. The reproduction of colours is as accurate as the photographic and production process will allow. All cheeses are cut by hand. As such, all weights referred to on www.hf-cheeses.com website are guidelines, and there can be some fluctuations around those guideline weights. We are unable to offer refunds for complaints arising from reasonable variations from stipulated guideline weights. However, we will always endeavour to deliver packages as close as possible to our guideline weights.
All of the product images on our website are for illustrative purposes only. As such, products and their packaging may vary from the pictures on the website. Please also consider that Highland Fine Cheeses Ltd produces a range of artisanal cheeses, as such, due to the nature of the products, our cheeses are subject to slight variation of taste, texture and aspect throughout the year.
Delivery
We use DPD Next Day for all of our deliveries. Whilst they are unable to guarantee delivery within 24hrs, we believe they are the best couriers in the market, with a completion rate very close to 100%.
Orders will be shipped on Tuesday and Wednesday only. Our delivery partner will attempt delivery twice.
Before completing your purchase, you must indicate instructions for the courier as to where your delivery should be left in the event nobody is present to receive the order. This is not a signed for service, so it can be simply 'on the porch', as well as 'with a neighbour'. It is important that you are as specific as possible with these instructions.
Please note that should your indicated preference not be secure, we are unable to assume liability for loss or damage incurred as a result of the cheese being left in/at that location. If our couriers deem a 'safe place' location not to be secure, either because it is exposed to the elements, or it is visible from the road, they may return to the depot with it. In such cases, you will be informed via the tracking service (text message and/or email) and with a slip through the letterbox. You can then either arrange re-delivery directly with them for the next day advising of a different safe place, or to collect from the depot. This should be done the following day to ensure the cheese remains in pristine condition. We can accept no liability if you are unavailable to either receive or collect your delivery the day following the scheduled delivery date where the 'safe place' has been deemed insecure by the courier.
If there is nobody due to be present at the delivery address on the estimated delivery date who can refrigerate the products, we are unable to accept liability for perished goods. It is your responsibility to ensure that someone will be present on the estimated delivery date, and that they are able to refrigerate the goods on that day.
On receipt of your order, we advise you refrigerate the cheese straight away.
Whilst DPD is an excellent service, it remains slightly short of 100% in terms of next day delivery. On the very rare occasion your cheese does not arrive within 24hr of despatch, it will arrive the next day. If it does arrive a day late, please do not worry about the condition of the cheese, as our boxes are designed to keep the cheese in the right conditions for 48hrs, or even longer when it is cold outside!
If your cheese has not arrived by the end of the next day, then please let us know as soon as possible, and we will investigate.
If there is nobody available to receive the delivery, or collect it, on either the day of delivery, or the following day, we are unable to offer any refunds or compensation provided the original delivery was delivered on one of those days.
It is therefore imperative that you ensure someone is available to either receive or collect the delivery on either the day, or the day after the scheduled delivery date.
Packaging safety
Our packaging contains re-usable, safe, cooling ice packs. However, we do advise keeping these out of reach of children. Our cardboard delivery boxes are 100% recyclable and biodegradable. Our boxes also contain paper filler to cushion the contents of the boxes. We would advise keeping all these components out of reach of children, and we cannot accept liability for any injuries that may occur that are either directly or indirectly linked to any packaging Highland Fine Cheeses Ltd delivers to you.
Complaints Procedure
All of our cheese is subject to rigorous testing and inspection prior to delivery to ensure it is in optimum condition when it is dispatched. In the unlikely event that you are unhappy with the condition of any of the products that you receive, please let us know immediately via email, including photographic evidence, and we will take any necessary action. Please do not return any cheese to us.
If you do not inform us of a problem within 2 days of receipt of the order, or you do not provide any photographic evidence relating to the complaint, we will be unable to accept your claim, or provide a refund.

These Terms and Conditions are governed by and written in accordance with the laws of Scotland. You agree to submit to the non-exclusive jurisdiction of the Scottish courts.
